Welcome to bejaui.com and the Home Sale Diagnostic provided by Bejaui & Associates ("Bejaui & Associates," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Home Sale Diagnostic, website, forms, reports, educational materials, and related services (collectively, the "Services"). By accessing the Services, completing the Home Sale Diagnostic, submitting information, or requesting a report, you acknowledge that you have read and agree to these Terms.

1. Purpose of the Home Sale Diagnostic

The Home Sale Diagnostic is an AI-generated educational and informational resource designed to help homeowners identify factors that may have contributed to a previous listing not selling and identify areas that may warrant further review before relisting. The Diagnostic uses information provided by you together with a scoring methodology and other information available to us. The Diagnostic is intended to provide general educational guidance and does not constitute a guarantee, prediction, certification, or representation that a property will sell.

2. No Appraisal, Valuation, or Guarantee

The Home Sale Diagnostic is not an appraisal, formal property valuation, comparative market analysis (CMA), property inspection, home inspection, legal opinion, tax advice, financial advice, or other professional opinion, unless expressly identified as such in a separate written service.

A Diagnostic score or report does not establish:

• the current market value of a property;
• an appropriate listing price;
• the probability that a property will sell;
• the amount or number of offers a property may receive; or
• the length of time a property may remain on the market.

Any pricing, marketing, preparation, or listing recommendation should be based on a property-specific review of current market conditions, comparable properties, competing inventory, property characteristics, and other relevant factors.

3. AI-Generated Content

The Diagnostic and portions of the report may be generated or assisted by artificial intelligence ("AI"). AI-generated information may contain errors, omissions, or inaccuracies. Bejaui & Associates does not represent that every AI-generated statement is complete or error-free. AI-generated results should be treated as educational guidance and should be independently evaluated before being relied upon for any significant real estate decision.

4. No Agency or Representation Relationship

Completing the Home Sale Diagnostic, submitting this form, receiving a report, communicating through the Site, or requesting additional information does not create a broker-client, agency, fiduciary, representation, or other professional relationship between you and Bejaui & Associates. Any real estate representation or agency relationship must be established through a separate written agreement as required by applicable law. Nothing in the Diagnostic, report, website, or communications should be interpreted as creating an agency relationship unless and until such a relationship is established through the appropriate written agreement.

5. Existing Listing Agreements

If you are currently under an active, exclusive listing agreement or other representation agreement with another broker or real estate agent, the Home Sale Diagnostic and any report provided through this Site are for informational and educational purposes only. The Diagnostic is not intended to solicit you to terminate, breach, or interfere with an existing listing or representation agreement, or to obtain your listing in violation of that agreement. You should review your existing agreement and consult your current broker or agent regarding your contractual obligations.

6. Information You Provide

You are responsible for providing information that is accurate and complete to the best of your knowledge. The Diagnostic is based in part on information you provide. Incomplete, inaccurate, outdated, or misunderstood information may affect your results. We may contact you to clarify information, discuss your results, respond to your inquiry, or provide information about real estate services, subject to applicable law and your communication preferences.

7. Diagnostic Scores and Recommendations

Diagnostic scores and recommendations are generated using the methodology established by Bejaui & Associates and information supplied by the user. Scores are not objectively determined measures of a property's marketability and should not be interpreted as such. Different information, changing market conditions, or professional review may produce different conclusions.

8. No Guarantee of Sale

Bejaui & Associates makes no guarantee regarding: whether a property will sell; the timing of a sale; the number or amount of offers; the final sale price; the property's market value; or the outcome of any future listing. Real estate outcomes depend on numerous factors outside our control.

9. Real Estate Advertising and Disclosures

The Services may constitute real estate advertising or solicitation. Applicable brokerage, license, and other disclosures will be provided as required by California law and applicable professional rules. The responsible brokerage and license information associated with the Services should be reviewed before relying upon any representation concerning Bejaui & Associates or its licensed professionals.

10. Third-Party Information

The Diagnostic or related reports may reference information obtained from third-party sources, including public records, multiple listing services, market-data providers, websites, advertising platforms, and other sources. We make reasonable efforts to use reliable information but do not guarantee that third-party information is complete, accurate, current, or error-free.

11. Educational Purpose

The Services are intended to provide general educational information. Nothing contained in the Services is intended to replace advice from an appropriately licensed or qualified professional regarding legal, tax, financial, inspection, appraisal, insurance, lending, or other specialized matters.

12. Communications

If you provide contact information, we may use that information to respond to your inquiry, provide your requested Diagnostic, communicate regarding your report, or provide information about our services, subject to applicable consent requirements and law. Where required, marketing communications and text messages will be subject to separate applicable consent and opt-out requirements. You may opt out of marketing communications using the instructions provided in those communications.

13. Privacy

Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy and California Notice at Collection. Those documents form an important part of your use of the Services.

14. Intellectual Property

15. Prohibited Use

You agree not to: use the Services for unlawful purposes; submit knowingly false or misleading information; attempt to interfere with the operation of the Site; copy or reproduce the Diagnostic methodology without authorization; attempt to gain unauthorized access to systems or data; or use information obtained through the Services in a manner that violates applicable law.

16. Changes to the Services

We may modify, suspend, discontinue, or change the Home Sale Diagnostic or other Services at any time. We may also modify the scoring methodology, questions, recommendations, or report format as the Services develop.

17. Changes to These Terms

We may update these Terms from time to time. When changes are made, the updated Terms will be posted with a revised Effective Date. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of those changes, to the extent permitted by law.

18. Governing Law

These Terms shall be governed by applicable California law, except where federal or other applicable law requires otherwise.
